U.S. Trade Rep & International Trade Commission Seek Grower Input For Section 201 Blueberry Import Investigation

As you may have read in this week’s NJ Farm Bureau newsletter or heard about elsewhere, following-up on a side comment about unfair trade practices concerning produce imports from Canada on an earlier phone call regarding the impact of COVID-19 on NJ agriculture, Congressman Jeff Van Drew arranged a meeting for growers with USDA Under Secretary for Trade and Foreign Affairs Ted McKinney. The meeting last week was hosted by Frank Donio Inc. Owner David Arena at his facility in Hammonton.

While Under Secretary McKinney provided an overview of his role through the USDA in working on trade deals for US products around the world, there was also a frank discussion about the need for farmer input into current investigations by the US Trade Representative and International Trade Commission (ITC). Called a Section 201 investigation, the ITC studies data from the agricultural community regarding import-export irregularities that cause unfair/unequal market access for American products. Such has been identified in the blueberry industry (see summary here).

Since the meeting, Representative Van Drew’s Legislative Assistant Haddon Antonucci provided the following summary of actions needed by South Jersey blueberry growers to be represented in the current investigation, including a request for your immediate attention as you must respond using the attached documents by Monday, November 16, a little more than a week from today.

This is Mr. Antonucci’s summary “regarding the Section 201 blueberry import investigation.”

The most important action item is ensuring that everyone in the South Jersey agricultural community fills out the ITC questionnaire. … attached [is] the producer questionnaire, there are also importer and purchaser questionnaires available on the website. This questionnaire collects proprietary information and will be used to help the ITC evaluate the impact of foreign imports of blueberries on domestic farmers. Also attached is a letter explaining the questionnaire and a document with ID codes.

“In order for the ITC to recommend action, there needs to be demonstrable harm to domestic industry. It is very important … to get this information to the ITC [to] demonstrate [any] deleterious impact that these imports have had on South Jersey agriculture.

“Please fill out this form as it pertains to your operations, and please provide it to other producers in the community as it pertains to their operations, particularly if they have not been contacted by the ITC yet.

“The deadline for the questionnaire is November 16. The point of contact at USTR is Jordan.Harriman@usitc.gov . Send [your questionnaire to] that email address once … completed. Congressman Van Drew’s office would like to be copied on your submission email so that he can file a holistic submission on behalf of the entire South Jersey agricultural community. And in answer to a question about his original message, he stated:

“This particular investigation pertains to blueberries exclusively. There are high level discussions regarding imports of bell peppers. It is possible that there will be another section 201 investigation later this year for bell peppers, but that has not been initiated yet.

Sept 11 Deadline Approaching for USDA’s Coronavirus Food Assistance Program Application

WASHINGTON, Aug. 28, 2020–U.S. Department of Agriculture (USDA) Farm Service Agency (FSA) reminds farmers and ranchers that the deadline to apply for the Coronavirus Food Assistance Program (CFAP) is Sept. 11, 2020. This program provides direct relief to producers who faced price declines and additional marketing costs due to COVID-19.

“FSA offers several options for farmers and ranchers to apply for CFAP, including a call center where employees can answer your questions and help you get started on your application,” said Richard Fordyce, Farm Service Agency administrator. “With only two weeks before the deadline, now is the time to check out the resources on our website and contact the call center or your local office for your last-minute questions.”

Over 160 commodities are eligible for CFAP, including certain non-specialty crops, livestock, dairy, wool, specialty crops, eggs, aquaculture, and nursery crops and cut flowers. All eligible commodities, payment rates, and calculations can be found on farmers.gov/cfap.

Customers seeking one-on-one support with the CFAP application process can call 877-508-8364 to speak directly with a USDA employee ready to offer general assistance. This is a recommended first step before a producer engages the team at the FSA county office at their local USDA Service Center.

Producers have several options for applying to the CFAP program by the Sept. 11 deadline:

  • Using an online portal, accessible at farmers.gov/cfap. This allows producers with secure USDA login credentials, known as eAuthentication, to certify eligible commodities online, digitally sign applications, and submit directly to the local USDA Service Center.
  • Completing the application form using our CFAP Application Generator and Payment Calculator found at farmers.gov/cfap. This Excel workbook allows customers to input information specific to their operation to determine estimated payments and populate the application form, which can be printed, then signed, and submitted to their local USDA Service Center.
  • Downloading the AD-3114 application form from farmers.gov/cfap and manually completing the form to submit to the local USDA Service Center by mail, electronically, or by hand delivery to an office drop box. In some limited cases, the office may be open for in-person business by appointment. Visit farmers.gov/coronavirus/service-center-status to check the status of your local office.

USDA Service Centers can also work with producers to complete and securely transmit digitally signed applications through two commercially available tools: Box and OneSpan. Producers who are interested in digitally signing their applications should notify their local service centers when calling to discuss the CFAP application process. All other eligibility forms, such as those related to adjusted gross income and payment information, can be downloaded from farmers.gov/cfap/apply. For existing FSA customers, these documents are likely already on file.

All USDA Service Centers are open for business, including some that are open to visitors to conduct business in person by appointment only. All Service Center visitors wishing to conduct business with FSA, Natural Resources Conservation Service or any other Service Center agency should call ahead and schedule an appointment. Service Centers that are open for appointments will pre-screen visitors based on health concerns or recent travel, and visitors must adhere to social distancing guidelines. Visitors are also required to wear a face covering during their appointment. USDA Farmers To Families Food Box Program – New Round Solicitation

Listening in USDA’s webinar reveals major changes in this latest solicitation for the third round of the Farmers to Families Food Box Program. This time they only want multi-commodity ‘combination boxes’, i.e. produce plus meat/dairy plus optional eggs! — check out the specs on page 4 of the solicitation here – https://www.ams.usda.gov/sites/default/files/media/FFFB_solicitationRound3.pdf). They are much more specific on items (weights/types) to be included in box.
There is also new emphasis on not passing on costs to food banks/NGOs – the contracted vendor now responsible for covering the cost of delivery from foodbank to individual (the last mile of distribution!?) so that needs to be included in the proposed box price.
There is no deadline for submission and proposals can be submitted immediately. This time the govt will review the proposal and then return for revision if there are questions or missing items (not done in first 2 rounds). They will help identify what is missing or needing revision! This solicitation will close when the Government has enough awardees in each region so it means the faster a complete proposal is submitted, the more likely of receiving a contract. Awards will begin on approval and last through Aug. 15, 2022.

Unsolicited Seeds From Foreign Sources

Several states are now reporting and you may have read or heard news reports of packets of seeds arriving in the mail from foreign shipping addresses that were not ordered. If you receive such a packet, DO NOT open or discard them. Rather, follow these directions from the NJ Dept of Agriculture:

We have been receiving reports of people receiving seeds in the mail from China that they did not order. Sometimes the seeds are sent in packages stating that the contents are jewelry. Unsolicited seeds could be invasive, introduce diseases to local plants, or be harmful to livestock.

Here’s what to do if you receive unsolicited seeds from another country:

This is known as agricultural smuggling. Report it to the USDA!

  1. DO NOT plant them and if they are in sealed packaging don’t open the sealed package.
  2. Take a photo of the package and seeds and send the photos to the New Jersey Department of Agriculture Joseph.zoltowski@ag.nj.gov and USDA SITC at  SITC.Mail@aphis.usda.gov
  3. Maintain the seeds and packaging and send to the USDA Office located at 1500 Lower Rd, Linden NJ 07036 for evidence.

USDA Urges Farmers to Take Steps Now to Prepare for Coronavirus Assistance

Local USDA Farm Service Agencies asked to have the following information shared. These may be details that will be discussed in the informational webinar scheduled for Thurs, May 14 at 1pm.

In April, USDA announced the Coronavirus Food Assistance Program (CFAP). CFAP will provide direct support based on losses for agriculture producers where prices and market supply chains have been significantly impacted and will assist eligible producers facing additional adjustment and marketing costs resulting from lost demand and short-term oversupply for the 2020 marketing year caused by COVID-19.

CFAP will provide assistance to most farms that have experienced at least a five percent loss and will be available to farms regardless of size. We are still working on the final details of the actual payment rates and those details will be determined and included as part of the rulemaking process. Once the rule making process is complete, the application period will be open and subject to the eligibility and payment limit criteria described in the rule.

As part of applying for the program, you’ll need to contact the Farm Service Agency county office to schedule an appointment. Your local FSA staff will work with you to apply for the program, and through forms asking for this type of information:

  • Contact
  • Personal, including your Tax Identification Number
  • Farming operating structure
  • Adjusted Gross Income to ensure eligibility
  • Direct deposit to enable payment

Please do not send any personal information to USDA without first initiating contact through a phone call. We take your privacy and security of your information very seriously.

If you are an existing customer, this information is likely on file at your local Service Center.

While the application process has not started, you can start gathering/understanding your farm’s recent sales and inventory.

FSA has streamlined the signup process to not require an acreage report at the time of application and a USDA farm number may not be immediately needed.

USDA Buy-Fresh Deadlines Still Short, But Proposals Due Next Week, Not Today

Staff from the USDA Agricultural Marketing Service (AMS) Commodity Procurement Division just held a webinar hosted by the United Fresh Produce Association to clarify the Buy-Fresh portion of the Coronavirus Food Assistance (CFAP) Purchase and Distribution Program. With an amazingly fast turn-around since this program was announced, they will be posting a ‘solicitation’ on Friday, April 24, announcing the purchase of up to $3 billion of fresh foods ($100 million/month each of US-grown fresh produce, fresh dairy, and fresh meats) beginning in 2 weeks. Proposals for fresh produce will be accepted from PACA-licensed growers/shippers/distributors/co-ops who submit proposals by next Friday to put together ‘consumer wholesale boxes’ for local/regional non-profits (food banks, food pantries, churches, etc.) and schools (which may or may not include universities/colleges – to be determined) to distribute to consumers. Approved proposals will be announced a week later to be implemented immediately.

Details of the program are available on the AMS website. The size of the box and contents (there are some targeted products) are to be worked out between the distributor and the non-profit, and included in the submitted proposal. ‘Fresh produce’ also includes ‘fresh-cut produce’, and anticipated changes in seasonal content should be outlined. Non-profit recipients may work with multiple distributors, especially as there may be different groups supplying produce, dairy and meat. The actual ‘solicitation‘ will be posted on Friday, April 24. New Jersey is serviced by 2 major food banks that distribute food to local pantries/feeding programs throughout the state. The Food Bank of South Jersey in Pennsauken services counties along the Delaware River from Mercer to Salem, while the rest of the state is under the umbrella of the Community Food Bank of NJ, headquartered in Newark with branches in Monmouth and Atlantic Counties. You could work with either of these larger organizations or directly with smaller community programs closer to your locale. You might also propose working with PhilAbundance, the major food bank servicing Philadelphia.
